Mediation

CoffyLaw, LLC > PRACTICE AREAS > Mediation

Mediation is a voluntary and confidential process in which a neutral third party helps disputing individuals or businesses reach a mutually acceptable resolution. Unlike litigation, where a judge or jury imposes a decision, mediation allows the parties themselves to maintain control over the outcome. The process encourages open communication, honest evaluation of the issues, and practical problem-solving.

Mediation Attorney Serving The Tri-State Area (NY, NJ, CT, PA)

Our New Jersey mediator works with both court-referred and private disputes. Before mediation begins, we typically hold pre-mediation discussions to identify the key issues and clarify each party’s goals. These preliminary steps help structure the sessions and make the most productive use of everyone’s time.

Then, during mediation, discussions may take place in joint sessions, private caucuses, or a combination tailored to the personalities and needs of the participants. One of the primary benefits of mediation is flexibility. Parties can explore a range of potential solutions, including monetary settlements, business arrangements, and creative resolutions that might not be available through litigation. At the same time, the mediator provides candid feedback to help participants realistically assess risks and potential outcomes.

It’s also important to note that the mediator remains impartial at all times and does not provide legal advice or represent any party. Each participant is encouraged to consult their own counsel before, during, and after mediation. Our approach at COFFYLAW focuses on fostering constructive dialogue, clarifying options, and guiding parties toward agreements that are practical, achievable, and mutually satisfactory.

Mediation FAQs

When considering mediation, it’s common to have questions about what the process involves and how it differs from traditional legal representation. At COFFYLAW, we provide clear guidance so you can feel confident in moving forward with our New Jersey mediation services.

What Does A Mediator Do?

Our New Jersey mediator acts solely as a neutral facilitator. We guide discussions, help clarify issues, and explore potential solutions. We do not make decisions for the parties, represent anyone, or provide legal advice. Each participant should have their own counsel to address legal questions or obligations. This separation allows the mediator to remain impartial while supporting productive conversations.

What Types Of Disputes Can Be Mediated?

Mediation can address a wide range of disputes, including business contracts, intellectual property issues, and commercial conflicts. Our New Jersey mediator works with both court-referred and private cases. Sessions can include joint meetings, private caucuses, or a combination depending on the needs of the parties. The goal is to promote open dialogue and practical problem-solving.

How Is Mediation Different From Arbitration Or Litigation?

Unlike arbitration, mediation does not result in a binding decision from a third party. Unlike litigation, there is no judgment imposed by a court. Mediation encourages collaboration and problem-solving, often reducing time, cost, and stress. Your mediator will stay neutral and help you and the other parties evaluate practical options while maintaining fairness and confidentiality.

How Should You Prepare For Mediation?

Participants should be ready to discuss key issues openly, provide necessary documents, and consider potential outcomes. While we facilitate the process and help focus discussions, each party is responsible for decisions regarding their interests. Consulting with counsel before, during, and after mediation helps clarify legal implications and protects all participants.

Does Contacting You Create An Attorney-Client Or Mediator Relationship?

No. Reaching out to us or participating in initial discussions does not create an attorney-client or mediator relationship. A formal mediation relationship exists only if all parties agree in writing. This ensures clarity about rights and responsibilities. Communications shared before a signed mediation agreement are treated as confidential but are not privileged until the process officially begins.

Why Choose Mediation For Dispute Resolution?

Mediation allows parties to address disputes in a structured but flexible setting, preserving relationships and exploring creative solutions that litigation may not offer. It provides a cost-effective, time-efficient alternative to traditional court processes while offering confidentiality and control over outcomes.

We encourage you to reach out to learn more about working with our mediator. Contact us to discuss how our mediation services can help parties resolve disputes efficiently, professionally, and confidentially.

Confidentiality Note

All communications regarding potential mediation are strictly confidential. No attorney-client or mediator relationship exists until confirmed in writing. Information shared during preliminary discussions or inquiries is not considered privileged or part of any official mediation unless a written agreement is executed.
